How is a BEE affidavit different from a BEE certificate?
A BEE Certificate is only required for big companies with a turnover in excess of R50 million per annum. A BEE Certificate is a big expensive process which requires audits and site visits and is usually done by big accounting firms. A BEE affidavit is required for EME’s and QSEs which are businesses with a turnover of less than R50 million per year. An EME is an exempt Micro Enterprise with a turnover of less than R10 million per annum.  A QSE  is a Qualified Small Enterprise with a turnover of more than R10 million but less than R50 million per annum.
Is a BEE affidavit a legal requirement?

What are the different levels of BEE on an affidavit
Level 1 – 100% black-owned Level 2 – between 99 and 51% black-owned Level 4 (this is not a typo) – between 50% and 0% black owned There is no level 3. Please note that a QSE level 4 can’t apply for a BEE affidavit, it has to apply for a BEE certificate
Does a BEE affidavit expire?
Yes it does – it needs to be renewed annually from the date of issue.  It is also required to be commissioned by a Commissioner of oaths for validation.

According to the Department of Trade and Industry a black person is defined as every race other than a white person who arrived in South Africa before 1994 and has a valid South African ID document.
